Monsanto has trumpeted reports generated by the Environmental Protection Agency (“EPA”) concluding that glyphosate is not hazardous… In this phase, which is limited to “general causation,” the Court will decide only whether there is sufficient admissible evidence that glyphosate and/or Roundup is capable of causing cancer (specifically, Non-Hodgkin’s Lymphoma) in humans.

Monsanto’s request to seal the documents submitted in connection with the motion to compel Rowland’s deposition is denied, with the exception of one document. Therefore, to support its sealing request, Monsanto must present compelling reasons for concealing documents relating to the EPA reports from the public… Potential embarrassment to Monsanto (or to Jess Rowland) is not enough.

Finally, the parties have submitted a discovery letter regarding Monsanto’s practice of designating a high percentage of documents produced in discovery as “confidential” in accordance with the protective order. That dispute is resolved in favor of Monsanto… when the plaintiffs provisionally file documents under seal based on Monsanto’s confidentiality designation, Monsanto must undertake a good-faith review of the documents and inform the Court whether they should remain under seal. [i.e. Monsanto will inform the court of whether Monsanto thinks its own documents should remain secret from the court.]

If Monsanto continues to file unreasonable or unsubstantiated declarations, it will be sanctioned.

Does Glyphosate / RoundUp cause Non-Hodgkin’s Lymphoma?

Because the shikimate pathway is only found in plants, it is assumed that glyphosate does not affect animals and therefore is safe; however, the retinoic acid signaling pathway in animals is very similar to the shikimate pathway. The makings of what could become the first successful class-action lawsuit against the world’s most evil corporation are giving a much-needed boost to the movement for clean food. Agri-giant Monsanto will soon face a barrage of lawsuits from a number of law firms over cancer-causing agents in its popular Roundup herbicide, which is reportedly making many people sick.

Two cases were recently filed in federal court in East St. Louis, and others are waiting in the wings to join them. Since the suits all claim the same thing – that glyphosate causes cancer – they may eventually be conjoined and filed as a class-action against the chemical behemoth, whose most popular herbicide was earlier this year declared by the World Health Organization (WHO) to cause cancer.

Since WHO released the findings through its International Agency for Research on Cancer (IARC), a prestigious body made up of scientific experts from all around the world, Monsanto has been the subject of increasing scrutiny over its popular herbicide product, which has been sprayed to the tune of tens of billions of pounds globally since the product was first released commercially.

Monsanto claims that the IARC’s conclusion that glyphosate probably causes cancer is bunk, and that it’s been “thoroughly discredited and rejected by the rigorous scientific research of governmental authorities around the world.” But plaintiffs in the various cases, as well as legions of independent scientists, wholeheartedly disagree, citing evidence that glyphosate is responsible for causing a number of different cancers, including non-Hodgkin’s lymphoma.

Class-action lawsuits make sense to consolidate laborious discovery process and help ensure victory

Since each individual case involving Roundup will be required to conduct extensive discovery concerning the safety, development and marketing of the herbicide going back to the mid-1970s, the plaintiffs in dozens of cases filed in the U.S. District Court for the Southern District of Illinois are hoping to combine their efforts in order to increase their chances of success.

“Each Plaintiff will need to conduct the same complicated regulatory and scientific discovery (spanning over 40 years) to demonstrate that exposure to Roundup caused their non-Hodgkin’s lymphoma,” a motion for the class-action states, as quoted by EcoWatch.

“To date, a few of the Roundup Cases have commenced discovery, but that discovery is being conducted under different, and sometimes conflicting, judicial constraints and orders. Centralizing these cases before one [Multidistrict Litigation] Judge to ensure that the discovery is done once for all claimants makes sense.”

The filing in Southern Illinois is strategic, as the midwestern state is the largest producer of soybeans, the vast majority of which are Roundup-Ready, genetically-modified (GM) soybeans manufactured by Monsanto. The Southern District of Illinois court is also located just 20 miles away from Monsanto’s St. Louis headquarters.

But the cases aren’t limited to just the Midwest. Lawsuits are springing up all across the country, as farmers and consumers alike report serious health effects from exposure to glyphosate and the foods upon which it’s being sprayed. The U.S. Environmental Protection Agency (EPA) recently filed a notice in the Federal Register concerning plans to have an eight-member scientific panel review IARC’s findings in order to reach a consensus.

The Securities and Exchange Commission has paid out the second largest settlement in U.S. history to a former Monsanto executive who blew the whistle on the biotech giant’s shady business dealings involving Roundup, a widely used herbicide containing glyphosate which was labeled a probable human carcinogen by the World Health Organization last spring.

The whistleblower’s identity is being kept secret, according to reports, presumably to protect the individual from the potential backlash of powerful industry groups.

The former Monsanto executive, who exposed “accounting improprieties” involving Roundup, has been awarded more than $22 million, according to CNBC.

“The award of $22,437,800 was tied to an $80 million settlement between the SEC and Monsanto in February, according to the lawyer, Stuart Meissner in New York, in a statement.”

Federal government accuses Monsanto of fudging sales numbers for weed killer

The SEC has accused Monsanto of lying about its earnings for Roundup. The allegations specifically involve a corporate rebate program designed to increase sales of the product.

The agency said that the seed giant “lacked sufficient internal controls to account for millions of dollars in rebates that it offered to retailers and distributors. It ultimately booked a sizeable amount of revenue, but then failed to recognize the costs of the rebate programs on its books.”

Monsanto reportedly “materially” distorted its consolidated earnings over a three-year period. The company is said to have “neither admitted nor denied” the allegations, while stating in the fiscal year 2015 that it was fully prepared to pay the resulting penalties.

“Company employees are in unique positions behind-the-scenes to unravel complex or deeply buried wrongdoing. Without this whistleblower’s courage, information, and assistance, it would have been extremely difficult for law enforcement to discover this securities fraud on its own,” said Jane Norberg, acting chief of the SEC’s Office of the Whistleblower.

SEC’s whistleblower program issues $107 million in five years

The agency was given the power to award whistleblowers under the Dodd Frank financial reform law, signed by President Obama in 2010 to prevent institutions from becoming “too big to fail.”

The program has so far awarded more than $107 million to 33 whistleblowers since its implementation in 2011. The largest award was issued in 2014, totaling $30 million.

Monsanto, of course, is no stranger to the legal system. The company is facing more resistance from the government over its plans to merge with John Deere, which manufactures farming, construction and forestry equipment.

Justice Department sues to block Monsanto, John Deere deal

Headquartered in Moline, Illinois, John Deere revealed its plans to acquire Monsanto’s Precision Planting back in November.

The Justice Department has filed a lawsuit to block the deal, arguing that if it goes through, it will give John Deere “a stranglehold on the market for high-speed precision-planting devices,” USA Today reports.

The two companies together sell 86 percent of all equipment in the precision-planting sector.

“If this deal were allowed to proceed, Deere would dominate the market for high-speed precision-planting systems and be able to raise prices and slow innovation at the expense of American farmers who rely on these systems,” said Renata Hesse, acting assistant attorney general of the Justice’s antitrust division.

John Deere and Monsanto claim that the merger is necessary to protect farmers, and will fight the lawsuit.

Monsanto is also considering an offer by the chemical and pharmaceutical giant Bayer. The German-based company offered $64 billion to purchase its agribusiness rival, Monsanto.

Was former New Brunswick chief medical officer of health, Dr. Eilish Cleary, on the verge of blowing the lid about Monsanto’s Roundup herbicide and its danger to humans? Or is it simply a bizarre coincidence that she was mysteriously fired from her position just weeks before she was set to unveil an official report assessing the risks associated with this pervasive weedkiller?

Many fear that this is yet another instance of corporate corruption silencing the truth about the world’s most widely used herbicide, which the World Heath Organization (WHO) found to be probably carcinogenic to humans.

“We need to see that report now,” Pohl’s letter demands. “It is not clear to us if your report has been scrapped, suppressed, or something else has happened.”

An earlier letter from Dr. Cleary to Pohl from last August, when she was still in her position, elicited a positive response about a formidable action plan to be released “in the coming year.” But, before that plan could be released, Dr. Cleary was told to pack her bags and go home, with no logically defensible reason as to why.

Shortly after Dr. Cleary’s firing, the province’s deputy minister of health, Tom Maston, released a statement claiming that Dr. Cleary’s release had absolutely nothing to do with her conclusions about glyphosate, nor did it have anything to do with the potential contents of her soon-to-be-released report.

But, not everyone is convinced, especially since Maston’s statement was a direct response to the widespread backlash that ensued over the controversial decision. When Dr. Cleary was first fired, no explanation whatsoever was given as to why, which is why many people throughout the region and country are asking some serious and pointed questions.

“Thousands and thousands of New Brunswickers share the concerns I have penned on behalf of our Kent County NB Chapter of the Council of Canadians,” Pohl’s letter adds with succinct clarity.

“Valid population and environmental health research of the risks associated with these compounds is urgently needed. We sincerely hope that the report you have been working on will meet the tests for being valid, in depth and independent. Please send me the report that we are promised.”

Part of the impetus for Pohl and others’ suspicions is that Canada’s Progressive Conservative (PC) Party had earlier tried to bury the findings of a report Dr. Cleary had conducted on shale gas, a.k.a. hydraulic fracturing, another hot-button political issue. Dr. Cleary’s work in this area was eventually allowed to be released, but only after considerable pressure was put on the PC government.

Canadian officials claim that Dr. Cleary’s report, with whatever changes or alterations are possibly being made under the direction of Dr. Russell, is “nearing completion,” though no official timeline for its publishing has been announced.

Consumer groups have been calling on the U.S. government to test foods for glyphosate residues on behalf of the public, amid a growing body of evidence showing that the chemical is harmful to human health.

Microbiologist Bruce Hemming was hired two years ago to test breast milk samples for residues of glyphosate, a key ingredient in popular weed-killer Roundup. Hemming is the founder of St. Louis-based Microbe Inotech Laboratories and was previously of the opinion that glyphosate was not able to accumulate in the human body.

In fact, Hemming previously worked as a scientist for Monsanto Co., the manufacturer of the popular and toxic herbicide Roundup. Despite his original doubts, Hemming’s lab tests did find residues of glyphosate in the samples of breast milk he received from a small group of mothers.

Food companies, consumer groups and academics have also solicited testing for glyphosate residues, fueled by fears that prevalent use of the pesticide on genetically engineered (GE) crops may be contributing to health problems, as people eat foods containing residues of glyphosate.

Fears have been growing thanks to some recent scientific studies that have revealed health problems tied to glyphosate, as well as data released by the U.S. Department of the Interior which found glyphosate in both water and air samples.

Health concerns regarding glyphosate

Roundup is routinely sprayed on GE crops that have been engineered to be able to tolerate the toxic glyphosate content, such as corn, soy, cotton, canola, sugar beets and alfalfa crops.

However, over recent years concerns have been growing regarding health problems that have been linked with glyphosate, which has started to contaminate the food we eat, water we drink and air we breathe.

People who are suffering with certain conditions have higher levels of glyphosate in their bodies than those who are healthy. The following are some of the conditions that have been associated with glyphosate:

  • In farming communities, there is a strong correlation between exposure to glyphosate and ADHD, possibly due to the chemical’s ability to disrupt thyroid hormone functions
  • Tests on Roundup in the lab show the same type of oxidative stress and neural cell death observed in Alzheimer’s disease
  • Roundup can disrupt the vitamin A-signaling pathway, which is crucial for normal fetal development – causing birth defects
  • Researchers found that if either parent has been exposed to glyphosate during the two years before a child’s birth, the chances of that child developing brain cancer doubled
  • Glyphosate has been found to induce human breast cancer cell growth via estrogen receptors, causing breast cancer

Consumer groups have been calling for the U.S. government to test foods for glyphosate residues on behalf of the public, in an attempt to establish what levels of glyphosate are common and whether the levels are dangerous. However, so far the requests have been ignored.

This doesn’t seem to be a particularly difficult request either – since 1991 the U.S. Department of Agriculture (USDA) has been annually collecting pesticide residue data in its Pesticide Data Program. This testing looks for residues on a range of food products, including baby formula and drinking water.

However, whilst testing occurs for other herbicides, fungicides and insecticides, it seems that the government agency does not test for glyphosate on a regular basis. The USDA claims that it would be too expensive to test for glyphosate residues – however, this seems like a poor excuse considering the costs already approved for the testing of other pesticide residues. It seems that the U.S. government is totally shirking its obligation to provide consumers with clarity over herbicide residues on food, and the associated dangers.

The European Commission has re-approved the use of glyphosate for another 18 months, despite repeatedly being unable to secure a majority decision from EU member states.

The last minute decision came as no surprise to most observers, and serves as testimony to how powerful the chemical industry truly is in terms of influencing legislation – even when the populace has consistently voiced its opposition.

“The EU’s current approval of glyphosate had been set to expire on Thursday [June 30] but due to the member state gridlock, the EU’s executive body had the final say on whether or not the controversial weedkiller remained on Europe’s shelves. Had glyphosate’s license been allowed to expire, manufacturers would have been given six months to phase out products containing the chemical, such as Monsanto’s Roundup and other herbicides. …

“Europe’s opinion of the widely used pesticide has been sharply divided ever since March 2015 when the World Health Organization’s International Agency for Research on Cancer classified glyphosate as a probable carcinogen. To complicate matters, other regulatory agencies such as the European Food Safety Authority, declared glyphosate as safe in November.”

Monsanto vs. the people

Despite the 18-month reprieve, glyphosate’s days may be numbered – at least in Europe. The commission had originally planned to extend the licensing of glyphosate for another 15 years, but growing public opposition to its use has forced a reassessment of its long-term use on the continent.

The 18-month extension will allow the European Chemicals Agency to continue its assessment of the safety of glyphosate, but Green Party members and other activists see the decision as a failure by the EU governing body to acknowledge the opposition.

Green Party MEP Bart Staes said:

“This decision by the commission to extend the approval of glyphosate in spite of last week’s vote shows a disdain for the opposition by the public and EU governments to this controversial toxic herbicide.

“As perhaps the first EU decision after the UK referendum, it shows the commission is failing to learn the clear lesson that the EU needs to finally start listening to its citizens again. This temporary extension must be the beginning of the end for glyphosate; we would now urge EU governments and regions to exercise their rights to impose significant restrictions on its use, so we can begin the process of phasing-out glyphosate.”

It has been revealed by European health commissioner, Vytenis Andriukaitis, that France, Germany and Italy had quietly pushed for reapproval of glyphosate, despite publicly supporting the opposition to renewal – a testament to the lobbying power of Monsanto and other companies who manufacture and sell glyphosate, the world’s most widely used herbicide.

It will be interesting to see how the purveyors of cancer-causing chemicals fare in the long run against an increasingly aware and opposed European populace – perhaps the days of widespread glyphosate use are finally nearing an end.

Permitted even in organic products, carrageenan is derived from a red seaweed compound in products like yogurt, coffee creamer, sour cream, cottage cheese, ice creams, soy milk, almond milk and coconut milk. Research shows that degraded carrageenan triggers inflammation, causes ulceration, and leads to malignancies in the gastrointestinal tract, including lesions, cancer and digestive disorders.

#7. Decaffeination process for coffee: Often involves soaking coffee beans in the toxic chemical benzene to dissolve the caffeine. Continual benzene exposure leads to neurological symptoms. Symptoms include dizziness, drowsiness, headaches and loss of consciousness. Larger doses cause vomiting, dizziness and convulsions, and can eventually lead to death. Within a matter of weeks, glyphosate, the primary ingredient in Monsanto’s Roundup, declared a likely human carcinogen by the World Health Organization last spring, may no longer be approved for use in Europe.

As we reported recently, the European Union is scrambling to reach an agreement regarding the relicensing of the world’s most widely used herbicide; however, time is running out, and instead of caving to pressure from companies like Monsanto, member countries are standing firm in their decision not to approve glyphosate renewal.

Establishment lawmakers controlled by the special interests of agrochemical companies have expressed outrage regarding EU member countries’ reluctance to endorse the renewal of Monsanto’s herbicide.

The EU’s health chief was reportedly “fuming” last week, after several key nations including Germany, Italy and France abstained from the June 6 vote to temporarily extend market approval of glyphosate for 12 to 18 months pending further scientific review.

This presents an enormous road block for the European Commission, as it is in desperate need of approval from either Germany, Italy or France. “EU majority rules require at least one of the three big countries to come on side, but they are so far refusing to show their hand,” reported Independent, an Irish-based news publication.

Despite failing to receive majority support or 65 percent of the EU’s population, the European Commission has decided to push forward with its plan to temporarily renew the glyphosate license through an appeal committee, which has scheduled a hearing for June 24.

If that fails, the European Union can technically adopt its own policy; however, this sort of blatant disregard for the people is far less tolerated in Europe than in other regions, such as in the U.S., where Monsanto is king and the government routinely ignores the American people with impunity. Eighty percent of Monsanto’s revenue is generated in the Americas, while Europe makes up less than 13 percent of sales.

Dismissing the rights of citizens is far less tolerated in Europe

“Three strikes must mean the approval of glyphosate is finally ruled out. After the third failed attempt, the Commission must stop continuing to try and force through the approval of glyphosate. Such a move would raise major democratic concerns about the EU’s decision-making process,” said Bart Staes, spokesman for green environment and food safety.

“The process of phasing out glyphosate and other toxic herbicides and pesticides from agriculture must begin now, and this means reorienting the EU’s Common Agricultural Policy towards a more sustainable agricultural model,” he adds.

As Staes and many other scientists and environmentalists point out, glyphosate use poses myriad risks, particularly with regard to public health and the environmental resources humans depend on for survival.

Glyphosate – as well as many other pesticides and industrial chemicals such as the plasticizer BPA – is a proven endocrine disruptor, meaning it mimics natural sex hormones in the human body, interfering with a range of important functions related to sexual and reproductive development.

Endocrine disruption in humans and animals adversely impacts the brain and the immune system, as well as causing cancer, according to the National Institute of Health. Other common endocrine disruptors include arsenic, mercury, lead, atrazine, phthalates and perchlorate.

Cancer is everywhere these days, it seems, and much of it is attributable to our modern lives: It is found in the foods we eat, caused by the devices we use and is ever present in the air we breathe.

And now, it seems, it is even in our toothpaste – a brand you may be using without even knowing it is likely carcinogenic.

As reported by Newsweek, the ingredient is a germicide known as triclosan, which is found in Colgate Total, a much-used brand manufactured by Colgate-Palmolive. Marketed since 1997, the company says it is the “only toothpaste approved by the FDA to help fight plaque and gingivitis” – which it does by lathering your teeth with triclosan.

That claim is at least half true, because no other toothpaste being sold in the U.S. contains the ingredient, although it is found in a number of antibacterial soaps and cosmetics as well. But triclosan’s bacteria-fighting ability is what has raised concerns recently about the safety of Colgate Total, as well as whether the Food and Drug Administration allowed it onto the market without paying heed to warnings regarding triclosan (as if that would be a first for the FDA).

“110 percent marketing”

For it’s part, the company is defending its product. On the Colgate Total website, the company falls back on the fact that it’s ingredient has been approved as “safe” by the FDA, adding:

Colgate recognizes the importance of continuous scientific study. We conduct research, publish papers, and actively participate in expert symposia on an ongoing basis. We closely investigate all new information.

We remain confident that ongoing independent reviews will continue to add to the substantial body of research that affirms the effectiveness and safety of triclosan in Colgate Total toothpaste.

Others are not so inclined to agree, however, mostly because of its association with causing cancer and antibiotic-resistant superbugs.

First used in the 1970s in hospitals, it has since become a widespread antimicrobial agent. Not only is triclosan present in Colgate Total and many household soaps, but it can also be found in coolers, odor-protected shoes and makeup, according to Mae Wu, a lawyer with the Natural Resources Defense Council. She says that triclosan is “all over the place,” even if, as she notes, we had “been doing fine without it” for several centuries of human-microbial cohabitation of the planet.

“Triclosan is 110 percent marketing,” says Michael Osterholm, who heads the Center for Infectious Disease Research and Policy at the University of Minnesota.

FDA won’t come out and call it dangerous

Osterholm helped Minnesota become the first state to ban nearly all uses of triclosan. He noted that the substance had been replaced by better, safer antimicrobial agents, and that Procter & Gamble was now advertising its popular Crest toothpaste as being “100% triclosan free.”

That could also be a marketing gimmick, but it is one that is likely to make more people ask if more products they use around the house also contain the compound, which would force Colgate to do something about it.

“They understand that the public is getting this,” Osterholm says of the Crest claim.

“Triclosan isn’t an essential ingredient in many products,” Dr. James M. Steckelberg of the Mayo Clinic wrote. “While triclosan added to toothpaste has been shown to help prevent gingivitis, there’s no evidence that antibacterial soaps and body washes containing triclosan provide any extra benefits, according to the Food and Drug Administration.”

The FDA, meanwhile, says on its website that soaps containing antibacterial agents like triclosan have not been “any more effective at preventing illness than washing with plain soap and water.” But the agency stops far short of calling triclosan a danger and only suggests that consumers think about buying a different product.
